Terms of Service

Effective Date: May 2, 2025

These Terms of Service (“Terms”) constitute a binding agreement between you (“User,” “you,” or “your”) and Yonder Wonder LLC (“Company,” “we,” “our,” or “us”) governing your access to and use of the Yonder Wonder Face Effects website and mobile application (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, please do not use the Service.

1. Eligibility

  • Age Requirement: The Service is available to individuals who are at least 13 years old. Users under 13 are not permitted to register or use the Service. 
  • Authority: By using the Service, you represent and warrant that you have the legal capacity and authority to enter into these Terms.

2. Account Registration and Security

  • Registration: To access certain features of the Service, you must register for an account by providing a valid email address and creating a password. An activation link will be sent to your email to confirm its validity.
  • Account Security: You are solely responsible for maintaining the confidentiality of your account credentials, including your password. You agree to immediately notify us if you suspect any unauthorized use of your account or any other breach of security.
  • Accurate Information: While we do not require additional personal details beyond your email and password, you agree that all information you provide is accurate and up-to-date.

3. Service Description

  • Overview: Yonder Wonder Face Effects allows you to upload your images and videos for transformation effects (such as aging, thinning, and other creative alterations). Users can then download the processed media.
  • Content Ownership: You retain full ownership of your original content (images and videos) uploaded to the Service.
  • Use of Your Content: When you upload images or videos, you give Yonder Wonder LLC permission to use your content solely for processing and delivering the transformation you request. In other words, your content is used only to perform the specific effects—such as aging or thinning—that you ask for. Additionally, we may occasionally use parts of this content to fine-tune our machine learning models, always for internal improvement purposes. Rest assured, we do not sell your content or use it for any unauthorized commercial purposes.
  • Content Moderation: Although our Service does not currently allow users to delete their previous submissions, we reserve the right to remove, moderate, or otherwise manage content at our discretion. Future versions of the Service may include additional user controls over content deletion and modification.

4. Service Fees and Payment

  • Free and Paid Features: Some features of the Service may be offered free of charge for an initial period or as part of a freemium model, while others will be available only to users who pay a fee. We reserve the right to modify our pricing and fee structure upon notice.
  • Payment Terms: If you elect to use paid features, you agree to pay all applicable fees as described at the time of purchase. All fees are non-refundable except as expressly required by law.

5. Acceptable Use and User Responsibilities

  • Permitted Uses: You agree to use the Service only for lawful purposes and in accordance with these Terms. You are responsible for ensuring that your use of the Service does not violate any applicable law or infringe the rights of any third party.
  • Prohibited Conduct: You agree not to:
    • Unlawful Activities: Use the Service to commit fraud, deception, or any other unlawful activity.
    • Defamatory or Infringing Content: Upload or share content that is defamatory, hateful, or otherwise in violation of third-party rights.
    • Copyright and Unauthorized Image Use: Upload, share, or submit any content that violates the intellectual property rights of others. This includes copyrighted materials or images of celebrities—or any individuals—for which you do not hold the necessary rights or permissions.
    • Harmful or Disruptive Actions: Use the Service for any activity that is harmful, abusive, or could damage, disable, or impair the Service.
  • Account Responsibility: You are responsible for all activities conducted under your account. In addition to safeguarding your credentials as noted in Section 2, you agree to notify us immediately if you believe your account has been compromised.

6. Intellectual Property

  • Our Proprietary Rights: Yonder Wonder LLC owns and retains all rights, title, and interest in and to the technology, software, algorithms, machine learning models, designs, and other intellectual property underlying the Service, regardless of whether such elements are developed in-house or by third parties.
  • User-Generated Content: Except for the license granted to us as described above, all user-generated content remains your property. You acknowledge that any processing or transformation effects applied to your content do not alter your original ownership rights.

7. Disclaimers and Warranty

  • As-Is Service: The Service is provided on an “as is” and “as available” basis without any warranties of any kind, either express or implied. Yonder Wonder LLC specifically disclaims any warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • No Guarantee of Results: We do not guarantee that the Service will be error-free, uninterrupted, or meet your requirements. Any reliance on the Service is at your own risk.

8. User Representations, Indemnification, and Limitation of Liability

(a) User Representations: By uploading or submitting content through the Service, you represent and warrant that:

  • You own the rights to the content or have obtained all necessary permissions and licenses (including for copyrighted materials or images of celebrities and other individuals) to upload and use the content.
  • Your content does not infringe upon or violate any intellectual property, privacy, or other rights of third parties.
  • You will not use the Service to spread misinformation, commit fraud, or engage in any other unlawful or unauthorized activity.

(b) Indemnification: You agree to indemnify, defend, and hold harmless Yonder Wonder LLC, its subsidiaries, affiliates, officers, directors, employees, and agents from any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to:

  • Your uploading or submission of content that is copyrighted or features images of celebrities or any other individuals without the proper authorization;
  • Any use of the Service to spread misinformation, commit fraud, or engage in other unlawful or unauthorized activities;
  • Any breach of these Terms or violation of any applicable law or regulation.

(c) Limitation of Liability: To the maximum extent permitted by law, Yonder Wonder LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including, but not limited to, loss of data, revenue, or profits) arising out of or relating to your use of or inability to use the Service—even if we have been advised of the possibility of such damages. In all cases, our total liability to you for any claims shall be limited to the amounts, if any, you have paid to us in the twelve months preceding the claim. You acknowledge that any action or claim brought against Yonder Wonder LLC as a result of your content or use of the Service is solely your responsibility.

9. Governing Law and Dispute Resolution

  • Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.
  • Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved exclusively by binding arbitration. You agree to waive any rights to pursue disputes in a court of law, including class action lawsuits. The arbitration shall be conducted in accordance with the rules of the American Arbitration Association (or a similar institution) and the decision rendered by the arbitrator(s) shall be final and binding on both parties. Each party shall bear its own costs and attorney’s fees in connection with the arbitration unless the arbitrator awards otherwise.

10. Modifications and Termination

  • Modifications to Terms: We reserve the right to modify these Terms at any time. Any changes will be posted on our website, and your continued use of the Service after such modifications constitutes acceptance of the revised Terms.
  • Termination: Yonder Wonder LLC may suspend or terminate your access to the Service immediately, without notice, if you (a) breach these Terms, (b) engage in any prohibited activity as outlined above, or (c) remain inactive for an extended period. We also reserve the right to terminate your account in the event of any other situation where continuing your access might harm the Service or its users.
  • Effect of Termination: Termination of your account or these Terms does not relieve you of any obligations incurred prior to termination.

11. Force Majeure and Miscellaneous Provisions

  • Force Majeure: Yonder Wonder LLC shall not be liable for any delay or failure to perform its obligations under these Terms due to events beyond its reasonable control, including natural disasters, war, terrorism, or other unforeseeable events.
  • Assignment: You may not assign these Terms or any of your rights or obligations hereunder without the prior written consent of Yonder Wonder LLC. We may assign these Terms without notice.
  • Severability: If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.
  • No Waiver: Our failure to enforce any provision of these Terms shall not be deemed a waiver of our right to enforce such provision in the future.
  • Relationship: Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between you and Yonder Wonder LLC.
  • Disclaimers on Transformative Effects: The Service’s transformation effects (e.g., aging, thinning) are offered for creative and entertainment purposes only. You agree not to use them to mislead, defraud, or otherwise harm others. Any use of the transformed media for deceptive or fraudulent purposes is strictly prohibited.
